01 Jan 2006 18:05 Thank you for your follow up. After receipt of your request that we reopen your claim I had our Risk Management Team further review your claim file. These claims are always difficult to resolve. We try to fairly and impartially consider all of the facts and circumstances submitted when ruling on these claims. We are well aware that in most situations someone is going to be bitter over the way the claim was resolved. Our goal in the claim resolution process is not to punish or reward someone, but to make a determination that is fair taking into consideration a multitude of factors to include but not limited to, the time frame of the purchase, the good faith conduct of each party, the claim and account history of each party, the amount in controversy, the funds available to resolve the controversy, and the nature of the program or purchase that is at issue. Some purchases come with inherent risks built in (investment programs that promise certain returns but that ultimately don’t pan out for whatever reason to include the site shut down). In most cases, the fact that you get no return on your money or lose your investment all together, is generally a known risk of that type purchase. All of this information is weighed into our decision. Although I know you don’t agree with our decision, we must again respectfully deny your claim. In denying this claim we are in no way stating or implying that this merchant is completely blameless or innocent, but there is not a remedy for every wrong that occurs. Our Risk Management Team asked that we try to better explain our claims process to you. Please understand that your business is truly important to us and we regret we were unable to issue you a refund in this particular case.
